Terms of Service
These Terms of Service ("Terms") govern your use of the Rogue Talent platform ("Platform"), operated by Rogue Talent Ltd ("we", "us", "our"), a company registered in England and Wales. By creating an account or using the Platform, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use Rogue Talent. By registering, you confirm that all information you provide is accurate and that you have the legal capacity to enter into these Terms. We reserve the right to refuse or revoke access at our discretion.
2. Account registration and verification
All users must complete identity verification before they can transact on the Platform. You are responsible for maintaining the security of your account credentials. You must not share your account or allow others to use it. We may suspend or terminate accounts that fail verification or provide false information.
3. The platform
Rogue Talent provides a marketplace that connects models (providers) with clients (customers). We are not a party to any booking agreement between users. We do not employ models, and we do not act as an agency. The Platform facilitates introductions, bookings, and secure payments.
4. Bookings and payments
When a client submits a booking request and it is accepted by the model, a binding agreement is formed between those two parties. Payment is collected from the client at the point of booking and held in escrow by our payment processor (Stripe). Upon completion of the booking, the model's full rate is released. Rogue Talent charges the client a booking fee of 15% of the model's rate. Models keep 100% of their rate; no fee is charged to models.
5. Cancellations and refunds
If you cancel a confirmed booking 48 hours or more before the shoot start time, you receive a full refund of everything you paid (the model's rate and the booking fee). If you cancel less than 48 hours before the shoot start time, the booking is non-refundable and the model is paid in full. If the model cancels a confirmed booking, you receive a full refund regardless of timing.
6. User conduct
You agree to use the Platform lawfully and in accordance with our Community Guidelines. You must not: use the Platform for any unlawful purpose; harass, threaten, or discriminate against other users; post false or misleading information; attempt to circumvent the Platform's payment system; or infringe the intellectual property rights of others.
7. Content and intellectual property
You retain ownership of content you upload to the Platform (including portfolio images). By uploading content, you grant Rogue Talent a non-exclusive, worldwide licence to display that content on the Platform for the purpose of operating the service. You must not upload content you do not have the right to share.
8. Limitation of liability
To the maximum extent permitted by law, Rogue Talent shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability to you shall not exceed the fees you have paid to us in the 12 months preceding the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
9. Termination
You may close your account at any time. We may suspend or terminate your account if you breach these Terms, fail verification, or engage in conduct that we reasonably consider harmful to the Platform or its users. Outstanding payments and obligations survive termination.
10. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
